 Declaration on violence against 10-year-old girls in Brazil and violation of the law of abortion, life and health

Us, researchers and researchers CLACSO Work Group Corpos, territories and feminisms We express our repudiation and indignation at the multiple violations of law carried out in the week of August 20 against a 10-year-old, pregnant girl, 04-year-old victim of statutory rape committed by a relative outside the state of Espírito Santo, Brazil. Victimized by the very serious crime of statutory rape, aggravated by the fact that the victim is under 14 years of age (art. 213, Penal Code), the child is also suffering with the attacks of political groups of religious fundamentalists who attempt to prevent the guarantee of legal and safe abortion in cases of statutory rape, typified in the Penal Code since 1940 (art. 128, II). In addition to verbally attacking and threatening children and their families, these groups spread the facts of childhood, violating the Statute of Children and Adolescents (arts. 5 to 17), as well as the Penal Code (art. 325), violating “violence, cruelty and oppression” and “violação de sigilo”. 

Not Brazil, or rape is socially and historically constructed, legitimized and tolerated from the genocidal colonial project that sustains its bases in simultaneous and articulated violence between bodies of women and two of our ancestral territories. The bodies of women, mainly indigenous and black women, are seen as properties that must be explored and violated. The “culture of statutory rape” allows such a crime, even legally considered heinous, to have a high degree of impunity and victim responsibility, such as it happens in the case of a 10-year-old girl. This culture is materialized in alarming numbers: 4 13-year-old girls are raped per hour in Brazil. 

The advance of totalitarianism and two religious fundamentalisms in the country aggravates the problematic situation of historical violence against women and represents a threat to the conquered human rights. Thanks to the mobilization of civil society and democratic institutions, the abortion was carried out safely. As a group, we also repudiate the manifestations that threaten human rights and especially the bodies and lives of women and children. We offer our solidarity to children and their families. Nenhum direito at least!
