Regarding the discussion in the Chamber of Deputies of the Labor Reform bill
The CLACSO Working Group “What work for what future?” expresses its deep concern and firm rejection of the Labor Reform project presented by the Argentine government, which will be discussed in the Chamber of Deputies next Thursday, February 19.
The project promoted by the Executive Branch introduces modifications that affect principles of Argentine labor law, violating guarantees enshrined in Article 14 bis of the National Constitution and in the fundamental conventions of the International Labour Organization (ILO) ratified by Argentina.
This initiative is not a technical update or a minor regulatory adjustment. It is a structural reform that alters the protective balance of labor law, weakening individual and collective rights historically won by the working class.
Labor law is not a gift or an accidental inheritance. It is the result of historical processes of social conflict, union organization, and the development of regulations aimed at protecting the structurally weaker party in the employment relationship. This is established by the National Constitution and recognized by international human rights treaties with constitutional status.
To argue that the precariousness of the Argentine labor market will be resolved by reducing rights is a flawed premise. Informality and the lack of job creation do not originate in the labor protection system and, therefore, will not be resolved by weakening guarantees.
From this CLACSO Working Group “What work for what future?” we reaffirm that it is not possible to build a future of work based on the reduction of guarantees, the fragmentation of collective representation and the transfer of risks to those who live on their wages.
We reiterate our commitment to defending decent work, to the unrestricted respect of the National Constitution and the international agreements ratified by Argentina, and to building alternatives that strengthen—and not weaken—social democracy.
